• Welcome to the online marketplace platform “6E Pick” https://www.goindigo.in/retail (“Platform” / “Website”) which is owned and operated by InterGlobe Aviation Limited, a company incorporated under the provisions of the Companies Act, 1956 and having its registered office at Upper Ground Floor, Thapar House, Gate No. 2 Western Wing, 124 Janpath, New Delhi, India (“IGA”, “Company”, “we”, “us”, or “our”).
• By accessing, browsing, or using the Platform you agree to be bound by these Terms and Conditions (“Terms”) which govern your access to and use of our Platform for booking hotels, cab services, tourist attraction tickets, purchasing travel accessories or any other products / services made available from time to time.
• The Company is engaged inter alia in the business of operating, managing and maintaining an internet-based marketplace platform facilitating and acting as a medium for interaction between the users and the third-party sellers (the “Company Services”).
• The Company Services provide the end customers (hereinafter referred to as “You” or “Your” or the “User”) with information / listings about certain products and services viz. hotels, cab services, tourist attraction tickets, travel accessories or such other products / services offered for sale by third party sellers (“Sellers”) from time to time.
• IGA reserves the right, at its sole discretion, to change or modify any part of these Terms at any time without prior notice. It is recommended for You to visit this page periodically to review the current Terms to which Your access and use of the Company Services are governed.
• Your continued use of the Platform constitutes your acceptance of the revised Terms. If the Terms are not acceptable, then the User should refrain from using the Company Services.
• The Company retains the right at any time to deny or suspend access to all or part of the Website to anyone who the Company believes has violated any of these Terms.
• These Terms and Conditions constitute an electronic record under the Information Technology Act, 2000 (“IT Act”) and the rules framed thereunder. This electronic record is generated by a computer system and does not require any physical or digital signatures.

• The Platform is a facilitator and technology service provider and operates solely as an online intermediary under the Information Technology Act, 2000, providing a technology-based marketplace to facilitate transactions between Users and independent third-party sellers of goods and services viz. hotels, cab services, tourist attraction tickets, travel accessories etc. and enables users to interact with the Sellers. The Platform does not own, sell, resell, control, endorse, warrant or guarantee any of the goods, services, made available by the Sellers on the Platform.
• Commercial and contractual terms—including pricing, payment, delivery, warranties and after-sales services—are solely determined by and agreed between You and the Sellers, forming a bipartite agreement to which IGA is not a party. The quality, fulfillment, and resolution of any issues related to goods or services lie entirely with the Sellers and IGA bears no responsibility or liability. IGA does not mediate disputes, influence terms, or endorse any offerings on the Platform. Upon acceptance of an offer by a Seller, products and services will be delivered as per the agreed terms and at the location specified in Your order. IGA does not implicitly or explicitly support or endorse the sale or purchase of any items or services on the Portal.

• All orders/bookings are placed with third-party Sellers listed on the Platform. The prices, availability, delivery, timelines, and service terms are provided by the respective Sellers.
• Payments for services/products are processed through integrated third-party payment gateways engaged by the Sellers. The Company is not responsible and/or liable for payment processing errors or disputes.
• All listings, service descriptions, ratings, and reviews are provided by the Sellers or collected from users and are not verified or endorsed by the Company.
• The invoice in relation to the Products and Services that are required to be delivered to You shall be issued by the concerned third-party seller which will process and satisfy the order for such Products and Services.
• YOU AGREE THAT YOUR ACCESS TO THE WEBSITE IS AT YOUR SOLE RISK AND OF YOUR FREE WILL. THE WEBSITE AND ALL MATERIAL THEREIN CONTAINED ARE DISTRIBUTED AND TRANSMITTED BY THE COMPANY ON AN “AS IS” AND “AS AVAILABLE” BASIS. IGA DOES NOT MAKE ANY REPRESENTATION OR WARRANTY IN RELATION TO ANY PRODUCT/SERVICE. YOU ARE ADVISED TO INDEPENDENTLY VERIFY THE BONA FIDES OF ANY PARTICULAR SELLER THAT YOU CHOOSE TO DEAL WITH ON THE PLATFORM AND USE YOUR BEST JUDGEMENT IN THAT BEHALF. THE COMPANY, ITS AFFILIATES, GROUP COMPANIES, THEIR RESPECTIVE DIRECTORS, KEY MANAGERIAL PERSONNEL AND EMPLOYEES DISCLAIM ANY AND ALL EXPRESS OR IMPLIED REPRESENTATIONS, WARRANTIES AND/OR CONDITIONS OF ANY KIND, INCLUDING BUT NOT LIMITED TO WARRANTIES OF COMPLETENESS, ACCURACY, RELIABILITY, SUITABILITY, FITNESS, MERCHANTABILITY, AVAILABILITY, QUALITY, FITNESS FOR ANY PURPOSE, NON-INFRINGEMENT, COMPATIBILITY AND/OR SECURITY.
• WE DISCLAIM ANY RESPONSIBILITY OR LIABILITY FOR ANY INFECTION, CONTAMINATION, OR DAMAGE TO YOUR SYSTEM OR DEVICE RESULTING FROM OR RELATED TO YOUR USE OF THE WEBSITE. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, THAT THE WEBSITE OR THE SERVER(S) HOSTING IT ARE FREE FROM VIRUSES, TROJAN HORSES, WORMS, MALWARE, SOFTWARE BOMBS, OR ANY OTHER HARMFUL COMPONENTS OR PROCESSES.
• EVERY EFFORT IS MADE TO KEEP THE WEBSITE RUNNING SMOOTHLY. HOWEVER, THE COMPANY TAKES NO RESPONSIBILITY FOR, AND WILL NOT BE LIABLE FOR, THE WEBSITE BEING UNAVAILABLE DUE TO ANY REASONS.

• To avail the Company Services, you will be required to create an account (“Account”) on the Platform. For this Account, you may be required to furnish certain details, including but not limited to your phone number. To create the Account, you must be at least 18 years of age.
• If you are below the age of 18 years, your continued use of the Website implies that your parent or legal guardian has reviewed and agreed to the Terms on your behalf. Your access is considered to be with their consent and supervision. Where the Users are minors, references to “User,” “You,” or “Your” include both you and your parent/legal guardian.
• You warrant that all information furnished in connection with your Account is and shall remain accurate and true. You agree to promptly update your details on the Platform in the event of any change to or modification of this information.
• You are solely responsible for maintaining the security and confidentiality of your Account and agree to immediately notify us of any disclosure or unauthorised use of your Account or any other breach of security with respect to your Account.
• You are liable and accountable for all activities that take place through your Account, including activities performed by persons other than you. We shall not be liable for any unauthorised access to your Account.
• Purchases on the Platform must only be for end consumption. Users must not use products purchased on the Platform for any commercial, promotional, resale or further distribution purposes.
• You agree to receive communications from us regarding (i) information about us and the Services, (ii) promotional offers and services from our third-party partners, and (iii) any other matter in relation to the Services.

• The Seller’s individual policies on cancellation, return, refund, and exchange will apply. Users are advised to carefully review such policies before making any booking or purchase.
• The Company does not provide refunds, returns, or replacements. Any disputes or claims must be resolved directly with the Seller.
• In the event of failure of service by the Seller (e.g., non-availability of hotel, delayed cab, ticket rejection, etc.), the Company disclaims any liability. The Seller shall be solely responsible for rectifying the issue or offering a remedy.

The Platform may contain links to third-party websites or services not controlled by the Company. We are not responsible for their content or practices. This Website may contain links to other websites owned and operated by third parties who are not related to the Company (“Third-Party Websites”). Third-Party Websites are not under the control of the Company, and the Company shall not be responsible for the content of any Third-Party Websites or any hyperlink contained in a Third-Party Website and makes no representation or warranty with respect to the content of any such Third-Party Websites.

To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or related to:

• Any transaction entered into with a Seller,
• Non-performance or deficiency in goods/services by a Seller.

You agree to fully indemnify, defend, and hold harmless the Company, including their respective directors, from and against all losses, claims, and damages, including legal fees, resulting from: (i) your violation of any term of these Terms; (ii) your violation of any third-party right, including without limitation any publicity, privacy, or intellectual property right; (iii) your breach of any applicable laws; (iv) any unauthorised, improper, illegal, or wrongful use of your account by any person, including a third party, whether or not authorised or permitted by you; and (v) your breach of any representation, warranty, covenant, or undertaking under these Terms of Use or under applicable law. This indemnification obligation will survive the expiry or termination of these Terms and your use of the Website.

• All rights in the Platform, including its trademarks, logos, domain names, software, design, content, and other materials, are owned by or licensed to the Company and protected under applicable intellectual property laws.
• Users are granted a limited, non-exclusive, non-transferable, and revocable licence to use the Platform for personal, lawful purposes in accordance with these Terms. No other rights are granted.
• Users shall not, without prior written consent:
  • reproduce, modify, distribute, or commercially exploit any part of the Platform;
  • reverse-engineer or attempt to access its source code;
  • use automated tools to extract data;
  • remove or alter proprietary notices; or
  • misuse the Company’s trademarks or content in a misleading or defamatory manner.
• Unauthorized use of the Platform’s intellectual property may result in legal action under applicable laws.

• Users may post content (“User Material”) on the Website, which does not reflect the Company’s views. The Company is not liable for any User Material or related damages and does not endorse it. By submitting content, you grant the Company a perpetual, worldwide, royalty-free license to use it in any media without compensation. The Company may monitor, modify, or remove User Material at its discretion but is not obligated to do so.
• You are solely responsible for all activities that occur under your account. You shall not:
  • violate any applicable law or regulation;
  • upload or share false, misleading, or defamatory content;
• By posting content, you confirm it (a) is original, does not violate third-party rights (including intellectual property rights), and (b) is not derogatory, abusive, malicious, or hurtful to any person, entity, group, caste, religion, race, or community, nor seditious, pornographic, vulgar, or in violation of any law.

• The Company may, at its sole discretion, suspend, restrict, or terminate a User’s access to the Platform, without prior notice, if:
  • the User violates these Terms or any applicable law;
  • the User provides false, inaccurate, or misleading information;
  • the User engages in fraudulent, abusive, or harmful conduct on the Platform; or
  • such action is required under law, regulatory direction, or order of a competent authority.
• Upon termination, the User shall immediately cease use of the Platform. Unless prohibited or restricted by law, termination will not affect the validity of any transaction lawfully concluded prior to termination or any obligations that have accrued before such termination.
• Termination or suspension shall be without prejudice

These Terms shall be governed by the laws of India, without reference to the conflict of laws principles. Any legal action or proceeding related to the other party’s access to, or use of, the Website or these Terms shall be subject to the exclusive jurisdiction of the courts at Delhi. All disputes will be subject to arbitration at New Delhi in English by a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Delhi, India.
